Licensing Information for the National Communications Authority (NCA)

Regulatory Framework

The National Communications Tariffs Regulations, 2016, are designed to establish a clear regulatory framework for the determination, setting, and approval of tariffs for telecommunications services. These regulations ensure that all tariff structures are fair, reasonable, and consistent with the principles of competition and market efficiency.

Licensing Obligations

All licensees are required to comply with the following obligations under the National Communications Tariffs Regulations, 2016:

  • Tariff Setting: Licensees must set tariffs that are just, reasonable, and transparent, allowing customers to clearly understand the nature of services provided and the associated costs. Tariffs must be non-discriminatory and ensure equal treatment for all users.

  • Filing of Tariff Rates: Licensees are required to file their tariff rates with the NCA on a quarterly basis. These rates must be made available to the public for review and inspection. Licensees are prohibited from charging customers any tariffs that have not been filed with and approved by the NCA.

  • Tariff Approval: Any tariffs for regulated services must be approved by the NCA prior to implementation. Licensees must submit an application for tariff approval, including all necessary documentation and calculations. The NCA has the authority to reject proposed tariffs if they are deemed unjustified, unfair, or unreasonable.

Increase of Tariffs

Licensees seeking to increase tariffs for regulated services must file an application with the NCA at least 30 days before the proposed increase is intended to take effect. The NCA will publish a notice of the proposed increase, inviting public comments or objections. The NCA will then consider these comments before making a final decision on the application.

Promotions and Special Offers

Licensees may offer promotions or special offers, but these must be approved by the NCA at least seven days before their implementation. All promotions and special offers must comply with the guidelines issued by the NCA and must be clearly communicated to customers, including details on terms, conditions, and any applicable charges.

Penalties for Non-Compliance

Non-compliance with the National Communications Tariffs Regulations, 2016, may result in significant penalties. Offenders may be subject to fines of up to USD 300,000 or imprisonment for a period not exceeding two years, or both, depending on the nature of the violation.
