Licensing Overview
The National Communications Authority (NCA) oversees the regulation and issuance of licenses for communications systems and services in South Sudan, in accordance with the National Communications Licensing Regulations, 2016. Below is a summary of the licensing process, requirements, and obligations for licensees.

Application for License
the application must be submitted in the prescribed manner and include the following:

Registration or identification documents from relevant authorities.

A valid contact address, including telephone number, facsimile, and email.

A detailed business plan for the proposed services, if applicable.

Comprehensive information about the proposed system or services.
-
Information on previous experience in managing similar systems or services, where applicable.

Any other information required by the NCA.
Failure to submit the necessary documents or information will result in the rejection of the application. However, applicants may resubmit their application as a new submission, provided it is not part of a tender process.
Granting, Renewal, and Revocation of License
Upon successful completion of the application process, the NCA may grant a license if all requirements are met. The terms and conditions of the license will be specified and must be adhered to by the licensee.

Renewal: Licensees must apply for renewal following the procedures set out by the NCA. Compliance with the terms and conditions of the previous license period will be considered during renewal.

Revocation: The NCA reserves the right to revoke any license in accordance with the provisions of the National Communications Act, 2012. Licensees have the right to appeal such decisions within 30 days.
Obligations of Licensees
Licensees are required to maintain high-quality services and ensure that their operations align with environmental and operational standards. Specific obligations include:

Improving service quality and addressing deficiencies.

Providing transparent information to subscribers.

Enhancing the performance of interconnected networks.

Contributing to the development of related communications markets
Quality Service Standards
The NCA establishes and monitors quality service standards, which licensees must adhere to. These standards are designed to be measurable, comparable, and accessible, ensuring compatibility with international benchmarks and addressing the needs of all users, including those with disabilities.
Duty of Care
Licensees must take all reasonable steps to minimize any public inconvenience, environmental damage, or adverse effects on public utilities during the installation and operation of communication systems.
Offences and Penalties
Operating without a valid license or contravening the provisions of the National Communications Licensing Regulations, 2016, is a serious offense. Violators may face fines up to USD 500,000, imprisonment for up to three years, or both.
